Terms of Service

Last updated October 24, 2026 · Web, iPhone, iPad and Android

Plain-English terms for using Kinetic View. Please also read our Privacy Policy.

1. Agreement and who we are

These Terms of Service ("Terms") are an agreement between Best ROI Media LLC, a Texas limited liability company ("Kinetic View", "we", "us"), and the company or other organization that creates or uses a Kinetic View account ("Customer", "you"). They cover the Kinetic View service on the web (kineticview.io and app.kineticview.io), the Kinetic View app for iPhone and iPad, and the Kinetic View app for Android, together with our help center and support (the "Service").

By creating an account, subscribing, or using the Service, you agree to these Terms and confirm that you have authority to accept them for your organization. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal information and is part of how the Service works.

2. Who can use Kinetic View

Kinetic View is a business tool for contractors, remodelers and home-service companies. It is not for personal, family or household use. You must be at least 18 years old and able to form a binding contract to create an account or accept these Terms. Each person who signs in must be an owner, employee or authorized contractor of the Customer.

You may not use the Service if you are barred from doing so under the laws of the United States or another applicable jurisdiction, or to build or benchmark a competing product.

3. Accounts, admins and roles

The person who creates a company account becomes its first administrator ("admin"). Admins can invite team members, assign roles (such as admin, manager, sales, call center or installer), change or remove access, connect integrations and AI assistants, manage billing and delete the company.

You are responsible for everyone you give access to, and for everything done under your company’s accounts, API keys and AI connections. Keep sign-in details and keys confidential, give each person only the access they need, and remove access promptly when someone leaves. Tell us right away at security@kineticview.io if you believe an account or key has been compromised.

Each person must use their own login. You are responsible for making sure your team’s use of the Service follows these Terms and the law.

4. Subscription and pricing

One subscription covers your whole company, with unlimited users, on the web, iPhone, iPad and Android. You only need one subscription per company, bought in one place: on the web, in the iPhone or iPad app, or in the Android app.

Founding member price: the first 8,888 companies to subscribe pay $49.99/month when they subscribe in the iPhone, iPad or Android app, or $49.99/month when they subscribe on the web. A company’s founding spot is counted at its first successful payment. The founding price stays locked for as long as that subscription stays active, including a store grace period or billing retry. Once a cancellation takes effect and the subscription ends, the founding price is lost and cannot be restored; subscribing again is a new subscription at the price then offered to new companies. A claimed founding spot is never reopened for someone else.

After the first 8,888 companies, the regular price for new companies is $199/month.

Prices are in U.S. dollars and do not include taxes, which may be added where required. We may change prices for new subscribers at any time. If we ever change the price of an existing subscription, we will give you advance notice as required by law and by Apple or Google, and the change will apply only from a future renewal. Apple and Google may also ask you to accept a price change before it applies.

Text messaging, email delivery, phone numbers, carrier registration and outside AI services are provided by third parties and are billed by them separately, not included in the Kinetic View subscription.

5. 14-day free trial

New companies get a 14-day free trial with the full Service. No payment card is needed to start. When the trial ends without a subscription, access to the workspace pauses until an admin subscribes; your data stays in place under the data and deletion terms below.

An admin can subscribe during the trial. On the web, the subscription starts right away and your first charge is on the day the trial would have ended, except in the last 2 days of a trial, when the first payment is taken the day you subscribe and the free trial ends. In the iPhone, iPad and Android apps, Apple or Google charges at purchase and the free trial ends, as shown on the purchase screen.

Each company gets one free trial. Creating extra companies to get more trial time is not allowed.

6. Automatic renewal and cancellation

Subscriptions renew automatically every month, and the payment method on file is charged each month until you cancel.

Web subscriptions (Stripe): an admin cancels from Billing in Kinetic View, which opens the Stripe billing portal. Store subscriptions: cancel through your Apple ID subscription settings (iPhone and iPad) or Google Play subscriptions (Android). We cannot cancel an App Store or Google Play subscription for you.

Cancellation stops the next renewal. You keep access until the end of the period you have already paid for, and then the subscription ends. Deleting the Kinetic View app, or deleting your own login, does not cancel a company subscription. Deleting the whole company automatically cancels a web subscription; store subscriptions must be turned off in the store first.

7. Payments and refunds

Web payments are processed by Stripe. App purchases are processed by Apple or Google under their terms. We never receive your full card number.

Web subscriptions are not prorated or refunded for partial months, unused time, or a company deleted mid-period, unless the law requires it. If you think you were charged in error, email billing@kineticview.io within 30 days of the charge and we will look into it.

Purchases made through the App Store or Google Play follow Apple’s or Google’s refund policies, and only they can issue those refunds. Request one from Apple (reportaproblem.apple.com) or Google Play.

If a web payment fails, we or Stripe may retry it. If it remains unpaid, access may pause until the balance is paid or the subscription ends.

8. Your data

Your data is yours. "Customer Data" means the information you and your users put into the Service, including customer and prospect records, appointments, messages, estimates, contracts, jobs, payments, files and photos. As between you and us, you own Customer Data. You give us permission to host, copy, process, transmit and display it only as needed to provide, secure and support the Service, to follow your instructions (including the integrations and AI connections you turn on), and to comply with the law.

You are responsible for having the rights and consents needed for the Customer Data you collect and upload, including information about homeowners and other people, and for its accuracy. Do not upload payment-card numbers, bank credentials, Social Security numbers, medical records or other sensitive information the Service is not designed for.

Export: admins can download company data at any time, including spreadsheets of customers, appointments, jobs, estimates, contracts and team, and a .zip of stored files and PDFs.

Deletion: an admin can delete the whole company from Settings → Company → Delete company account. Deletion is immediate and permanent, removes the company’s records, files and team logins from the live service, and cannot be undone, so export first. Encrypted backups containing deleted data are erased automatically within 30 days. Any user can delete their own login from Security → Delete account; business records stay with the company. See kineticview.io/help/account-deletion.

We do not sell Customer Data. We may use aggregated, de-identified information about how the Service is used (that does not identify you, your users or your customers) to operate and improve the Service, as described in the Privacy Policy.

9. Texting, email and calling compliance

Kinetic View lets you send texts and emails through providers you connect, such as SimpleTexting or Twilio for texting and our email service. You are the sender of those messages and are solely responsible for them.

You are responsible for complying with all laws that apply to your messages and calls, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Telemarketing Sales Rule, state telemarketing and texting laws, Do Not Call rules, carrier requirements (such as A2P 10DLC registration) and your providers’ policies. That includes getting and keeping records of any consent required before you text or call someone, identifying your business, honoring STOP, unsubscribe and do-not-contact requests promptly, and respecting quiet hours.

Importing contacts does not create texting consent. Do not use the Service to send messages to people who have not agreed to receive them where consent is required.

10. Third-party services and AI assistants

The Service works with services we do not control, such as Apple, Google, Stripe, texting and email providers, maps, calendars, lead sources, and Best Estimator. Your use of them is governed by their own terms and privacy policies, and they may charge their own fees.

Kinetic View includes optional built-in AI features (setup help, support chat and report assistance). You can also connect an outside AI assistant, such as Claude, ChatGPT/Codex, Grok or another tool that supports MCP, using a key an admin creates. Outside AI assistants are separate services with their own terms, privacy practices and fees; you choose them, and you are responsible for the access and permissions you give them and the actions you approve.

AI output can be wrong or incomplete. Review AI suggestions, setup changes, messages and numbers before relying on or approving them.

11. Acceptable use

Do not use the Service to: break the law or anyone’s rights; send spam or messages without required consent; harass, threaten or defraud anyone; upload malware or content you have no right to use; try to get into accounts, companies or data that are not yours; probe, scan or test the Service’s security without our written permission (report issues to security@kineticview.io instead); overload, disrupt or reverse-engineer the Service except where the law allows; scrape it or resell it; or get around usage limits, billing or the one-trial rule.

We may set reasonable limits, such as rate limits, file sizes or storage, to keep the Service working for everyone.

12. Availability, changes and support

We work to keep Kinetic View running and your data safe, but the Service is provided without a service-level agreement (SLA) or uptime guarantee. It may be unavailable at times, for example for maintenance, updates, outages of our hosting or other providers, or events outside our control.

We improve the Service over time and may add, change or remove features. If we remove a major feature you pay for, we will try to give reasonable notice. Support is available at support@kineticview.io and through Support in the app.

13. Suspension and termination

You may stop using the Service and cancel at any time, as described above.

We may suspend or limit access, immediately if needed, if you breach these Terms, do not pay, create a security or legal risk, or if your use harms others or the Service. When it is reasonable, we will tell you first and give you a chance to fix the problem. We may end these Terms or close an account for a material breach that is not fixed, for repeated violations, or as required by law.

If we end the Service for you without cause, we will give reasonable notice so you can export your data. Sections that by their nature should continue (such as data, payment, disclaimers, limitation of liability, indemnity and governing law) continue after these Terms end.

14. Disclaimers

Kinetic View is a business tool. It does not give legal, tax, accounting, financial, engineering or construction advice. You are responsible for your estimates, prices, contracts, permits, licensing, workmanship and dealings with your customers. Calculations, templates, starter settings, AI output and sample content are tools to help you, not guarantees.

TO THE EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DATA WILL NEVER BE LOST.

15. Limitation of liability

TO THE EXTENT THE LAW ALLOWS: (A) NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL OR DATA, EVEN IF ADVISED THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

For subscriptions bought through Apple or Google, "fees you paid to us" means the subscription fees paid for your company’s subscription in that period. These limits do not apply to your payment obligations, your indemnity obligations, or liability that cannot be limited by law.

16. Indemnity

You will defend, indemnify and hold harmless Best ROI Media LLC and its owners, employees and contractors from any third-party claim, and the related losses, damages, fines, penalties and reasonable legal fees, arising from: your Customer Data; messages, calls or emails you send through the Service (including TCPA, CAN-SPAM and similar claims); your use of third-party services or AI assistants you connect; your work and dealings with your customers; or your or your users’ breach of these Terms or the law. We will tell you promptly about the claim and reasonably cooperate, and you may not settle a claim that imposes obligations on us without our consent.

17. Governing law and venue

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Any lawsuit relating to the Service or these Terms must be brought in the state or federal courts located in Harris County, Texas, and both parties consent to personal jurisdiction and venue there. Either party may seek an injunction in any court to protect its intellectual property or data.

Before filing a claim, please email support@kineticview.io so we can try to resolve it informally within 30 days.

18. General terms

We own the Service, including its software, design and content (other than Customer Data). You receive a limited, non-exclusive, non-transferable right to use it during your subscription or trial under these Terms. If you send us feedback or suggestions, we may use them without obligation to you.

You may not transfer these Terms without our written consent, except with the sale of your business. We may transfer them with a merger, acquisition or sale of our business. If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a term is not a waiver. Neither party is liable for delays caused by events beyond its reasonable control. These Terms, together with the Privacy Policy and any order or plan terms shown at purchase, are the whole agreement about the Service. For app purchases, Apple’s and Google’s purchase terms also apply to the store transaction, and Apple and Google are not responsible for the Service.

19. Changes to these Terms

We may update these Terms as the Service and the law change. We will post the new version here with a new "Last updated" date. For material changes, we will give notice by email to admins or in the Service at least 14 days before they take effect, unless a change is required sooner by law or for security. Continuing to use the Service after changes take effect means you accept them. If you do not agree, cancel before they take effect.
